Hanyar Da Aka Bi Wajen Tabbatar Da Hukuncin Kisa Ga Maryam Sanda Bai Yi Daidai Da Hanyar Da Shari’ar Musulunci Ke Tabbatar Da Hukuncin Kisa Akan Wanda Ake Tuhuma Da Kisan Rai Ba- Daga Rayyahi Sani Khalifa

Lallai ya tabbata a shari’ar Musulunci cewa duk wanda ya kashe a kashe shi, kamar yanda Allah ya fada a cikin Alqur’ani.

(وكتبنا عليهم فيها أن النفس بالنفس)

Amma kamin a tabbatar da hukuncin kisa akan wanda ake tuhuma, se an samu shaida bayyanane, shaidar da shari’a ke bukat ya kasu kashi uku, ga su nan kamar haka :

1. Furucin wanda ake tuhuma/amsa laifi : ma’ana wanda ake tuhuma ya furta da kansa cikin hankalinsa ba kuma tare da an tilasta shi ba cewa shi yayi kisa ran, a nan sharadi ne wanda ake tuhumar ya kasance baligi/Mukallafi ba yaro ba, sannan dole ya zamo shiryayye/rashidi wanda ba sahuhu ba.

2. Shaidun mutum biyu adalai (kamamu, mutanen kirki) wadanda suka ga lokacin da wanda ake tuhuma yayi kisan, kuma dole se sun bada shaida iri daya misali kowanne yace ya yanka shi ne da wuka, idan labarin su ya banbanta da na juna kamar daya yace ya yanka shi da wuka dayan yace sukan shi yayi da wuka to hukunci ba zai tabbata ba.

3. Rantsuwa : A nan idan ba’a samu Furuci ba, ma’ana wanda ake tuhuma bai amsa laifi ba, kuma ba’a samu cikakkun shaidu biyu da suka halarci kisan ran ba, se a koma ma hukuncin rantsuwa. Yanda ake hukuncin rantsuwa kuwa shine ‘yan uwa ko waliyan mammaci zasu rantse rantsuwa hamsin (50) da cewa wanda ake tuhuma shi ya kashe dan uwansu, idan sun kai su hamsin se kowa yayi rantsuwa daya idan basu kai ba se a raba rantsuwa hamsin din a tsakaninsu, amma sharadi ne masu rantuswan se sun kai mutum biyu daga nan har mutum hamsin.

Akan yi hukuncin rantsuwa ne idan aka samu haluluwa kamar haka :

01. Idan aka samu shaida daya akan kisa ba’a samu cikon na biyu ba,

02. Idan aka samu mutum cikin jini kafin ya mutu ya kuma furta sunan wanda ake tuhuma yace shi ya ji masa ciwo.

03. Idan aka samu shaidu biyu wadanda suka ga lokacin da wanda ake tuhuma ya ji ma wanda ya mutu ciwo amma bayan nan mamacin yayi jinya har yaci abinci ya sha ruwa sannan daga bisani ya mutu.

4. Idan aka zo aka ga mutum tsaye akan gawa jina jina da jini, a nan kamin a zo maganar rantsuwa se an lura da halin da aka ga wanda ake tuhumar, idan aka ga alamu wanda yake nuna shi yai kisan se maganar rantsuwa ya taso, misali se aka ganshi rike da wuka kwabe da jini, ko kuma aka ganshi da bindiga a hannu idan harbe mamacin akayi. Kaga wannan sharadin yana nuna muna cewa idan ba’a ga wanda ake tuhuma cikin halin da yake nuna alamun ya aikata kisan rai ba to maganar tuhuma da rantsuwa ma bai taso ba. Wannan hukunci na karshe shine hukuncin da yayi kama da na wannan baiwar Allahn da ake kira Maryam Sanda.

Magana na karshe hukuncin da aka yanke mata na kisa ta hanyar rataya ya sabawa shari’ar musulunci domin shi Musulunci ya tsara cewa za’a yiwa mutum sakayyya ne idan an tabbatar da laifinsa da irin kisan da yayi kamar yanda yazo a littafin Mukhtasar (وقتل بما قتل ولو نارا) misali kamar yanda aka ce ta daba mishi wuka bisa adalci na shari’a ita ma za’a yanke mata hukuncin kisa ne ta hanyar daba wuka ba rataya ba, saboda gudun zalinci, saboda idan ya zamo kisan rataya yafi kisan wuka azaba to an zalince ta idan kuma ya kisan rataya ya gaza na wuka azaba to ba’ai mata hukunci daidai da abinda ta aikata ba, Allahuma sai dai idan hanyar da mai kisan yayi kisa ya sabawa shari’a kamar luwadi da shan giya da sihiri d.s, a nan ba za’a kashe shi ta wadannan hanyoyi ba se abi wani hanyar.

A karshe mu sani idan iyayen/waliyan wanda aka kashe suka yafe jinin danuwansu to shari’a bata fa hurumin tabbatar da hukuncin kisa akan wanda ake tuhuma ko da shaidu sun tabbatar da kisan.
Abinda yasa na rubuta wannan jawabin shine ganin yanda wasu mutane ke danganta hukuncin da akayi mata da hukuncin shari’ar musulunci, ciki har da masu da’awar ilimi, dan haka nayi wannan rubutun domin na kawar da shubhar da ke cikin wannan lamari, ya kamata mutane su san cewa idan musulunci yayi hukunci ba kai tsaye ake tabbatar da hukuncin ba, dole se an bi tsari da ka’idojin da shari’a ta tanadar kafin a tabbatar da hukuncin, rashin sanin haka ke haifar da mummunar fahimta ga hukunce hukuncen shari’a, wanda har yake kai wadansu suke daukan makami suna barna da sunan addini, irin rashin sanin wadannan ka’idoji ne musababbin ta’addacin da wasu ke yi da sunan addini, daga sunji ance ayi jihadi se suka dauki makami suna kashe mutane ba tare da sanin hanyoyin da ake bi kamin a aiwatar da ingantaccen jihadi ba.
